We will not undertake the building works for any house and land package. The building works will be carried out by a building contractor from our panel of approved builders in accordance with design guidelines for Wyndham Harbour. You will enter into the building contract with the building contractor.

Final package prices and specifications will depend upon a range of variable factors outside our control including, but not limited to, building contractor requirements and variations, council building approvals and planning consent, finance, soil test and survey results, the final plans, specifications, fixtures and materials selected and the requirements of any government (state or local) body or any public, statutory, municipal or judicial body.

Actual specifications for a particular home will be set out in the specific building contract.

Apartment Description and Prices

Images, drawings, floor plans, dimensions, sizes and areas, materials, finishes, fittings and other information displayed on this web site for apartment types are for illustrative purposes only.

The actual apartments available for purchase will depend upon a range of variable factors outside our control, including, but not limited to, council building approvals and planning consent, finance, soil test and survey results, the final plans, specifications, fixtures and materials selected and the requirements of any government (state or local) body or any public, statutory, municipal or judicial body.

Marina Berth Description and Prices

Images, drawings, plans, dimensions, sizes and areas, location, and other information displayed on this web site for marina berths are for illustrative purposes only.

The actual marina berths available at Wyndham Harbour marina will depend upon a range of variable factors outside our control, including, but not limited to, council building approvals and planning consent, finance, survey results, and the requirements of any government (state or local) body or any public, statutory, municipal or judicial body.

Approximate measurements and the locations of marina berths will be set out in the licence agreement.

The premiums and rents specified for marina berths are indicative premiums and rents only. The terms of each licence agreement, including but not limited to, the length of the term of each licence agreement, the rent or premium payable for each licence agreement and the outgoings for each licence agreement (including, but not limited to maintenance and management contributions) may vary for each marina berth.

The marina berth will be a licence agreement. The length of the term of each licence will never exceed the length of the term of the head licence for the marina, which is 99 years. As the marina berth licence will not commence until the marina has been constructed, the time it takes to construct the marina will be deducted from the length of the term of the marina berth licence advertised on this website.

Wyndham Harbour Master Plan

The Wyndham Harbour Master Plan depicting the first and future stages for Wyndham Harbour, and the images, dimensions, sizes and areas, facilities, amenities, infrastructure, number of land lots, apartments and marina berths, the configuration of the facilities, amenities, infrastructure, land lots, apartments and marina berths and other information displayed on that plan are for illustrative purposes only.

The actual stages, facilities, amenities, infrastructure, number of land lots, apartments and marina berths and the configuration of the facilities, amenities, infrastructure, land lots, apartments and marina berths at Wyndham Harbour may change depending on a range of variable factors including, but not limited to:

council building approvals and planning consent, finance, soil test and survey results and the requirements of any government (state or local) body or any public, statutory, municipal or judicial body; and
our feasibility studies and projections and market conditions.

As at 31 May 2010, that part of the land contained in the 'Future Stages' section of the Wyndham Harbour Master Plan shaded light pink and marked 'Subject to Rezoning' is zoned as green wedge, and must be rezoned before it can be incorporated into the Wyndham Harbour development. If it is not rezoned, it may not be developed as part of the Wyndham Harbour development, or developed at all. For further information, please contact us.

We may update or amend these Terms and Conditions and our Privacy Policy at any time without notice. The then current version of the Terms and Conditions and Privacy Policy will apply each time you use our web site.

We accept no liability for any failure to comply with these Terms and Conditions where such failure is due to circumstances beyond our reasonable control.

If we waive any rights available to us under these Terms and Conditions on one occasion, this does not mean that those rights will automatically be waived on any other occasion.

Boat Show 2010 Promotion Terms and Conditions

Register at the Melbourne Boat Show between 1-5 July 2010 and win a weekend away at The Mansion Hotel and Spa Werribee Park.

The promoter is Wyndham Harbour Pty Ltd ABN 43 100 847 809 of Level 1, 70 Dorcas Street Southbank Vic 3006.
Employees of the Promoter, its agencies, immediate families and related companies or companies involved in this promotion are ineligible to enter.
Entry is only open from 10 am on 1 July 2010 to natural persons who return a completed Registration Form to Wyndham Harbour Boat Show Stand A38 before 5 pm on Monday 5 July 2010 (Eligible Entry).
Each person may only enter the competition once.
Instructions on how to enter and the prize details form part of the conditions of entry. The Promoter will have sole and absolute discretion as to whether to accept any entry. The Promoter's decision is final and no correspondence will be entered into.
Entry to the competition is valid upon receipt by the Promoter of an Eligible Entry during the period of the Boat Show (1 -5 July 2010). By making an entry you are deemed to have accepted the terms and conditions of this agreement.
The prize value is $420 and will take the form of a voucher for overnight accommodation for two at The Mansion Hotel and Spa Werribee Park in a Classic Room, (breakfast included the following morning) and dinner for two in Joseph’s Restaurant (Prize).
Where the prize involves travel or accommodation, all arrangements, including but not limited to travel or accommodation times and dates, shall be in accordance with the restrictions specified by the Promoter and, unless stated otherwise in writing, shall take place by the relevant closing date being December 24, 2010.
The Prize is strictly as stated above and is not exchangeable, transferable, substitutable or convertible to cash.
The winner of the competition (Prize Winner) will be selected on Monday 5 July 2010 via a barrel draw at 5 pm at the Boat Show Stand A38 (Prize Draw).
The winner will be notified in writing by email and/or post to the addresses provided in the Registration Form and will be announced in The Weekly Review on Wednesday 14 July 2010.
The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry which is not in accordance with these terms and conditions. Incomplete or incomprehensible entries are not valid and will not be included in the draw.
The Promoter will take reasonable steps to ensure that the Prize is distributed to the Prize Winner within 28 days of the Prize Draw or any other period agreed between the Promoter and the Prize Winner.
If reasonable efforts have been made by the Promoter to identify or contact the Prize Winner but the Prize remains unclaimed after 28 days or the Prize Winner is disqualified, the Promoter may retain the Prize or draw an additional entrant’s name.
To the extent permitted by the law, the Promoter shall not be liable for any loss, damage or injury howsoever suffered or sustained (including but not limited to direct, indirect, special or consequential loss or damage, loss revenue or profit) arising directly or indirectly out of or in connection with this Promotion and/or Prize.
The Promoter may collect, use, retain or disclose your personal information to third parties from each Eligible Entry where you have requested it or to provide the Promoter's products and services or promotional details that may be of interest to you and to provide you with information relating to the Promoter.
